The website, www.goddessswag.com and its content is owned by Goddess Swag. When you use our website, and in email and other electronic messages between us, and/or any applications we may provide (including mobile applications), via the Goddess Swag website and/or our related social media websites such as; Facebook, Instagram, Twitter, etc., you are accepting the practices described in this Privacy Policy and you expressly consent to the terms and application of this Privacy Policy to the collection, storage, use and disclosure of all your personal information as described. If you do not agree to the terms of this Privacy Policy, do not access or use any part of this website, mobile applications and/or social media websites listed above.
Revisions to this Privacy Policy
Goddess Swag reserves the right, with or without notice, to make changes to this Agreement at Goddess Swag's sole discretion and at any time. Such changes will be effective from the time they are posted, provided that any material change to why we collect, use, or disclose your personal data will not apply to you, where your consent is required to such collection, use or disclosure, until we have obtained your consent to such change. Continued use of any part of this website constitutes your acceptance of such changes.
Applicability
This Privacy Policy does not apply to information collected by us offline, on a website operated by a third party, including through an application or content (including advertising) that may link to or be accessible from our website. The Privacy Policy does not apply to information from or about you collected by third parties such as Goddess Swag service providers, including but not limited to, Shopify, Inc, our website hosting company, Third Party Payment Processors, including PayPal, Inc., Shopify Payments, and any other payment gateways and/or payment methods accepted on the Site, as well as our social media pages.
Age of Consent and Children's Online Privacy Protection Act Compliance (COPPA)
You must be at least 13 years old or older to gain access to our website and its contents. This website is not intended for those who are under 13 years old. Company does not knowingly collect any information from anyone who is under 13 years of age and does so in compliance with the Children’s Online Privacy Protection Act as well as the General Data Protection Regulation of the European Union. This website, as well as its contents, is directed solely to individuals who are at least 13 years old and older.
If we learn we have collected Personal Data from a child under 13 without parental consent, we will delete that information, unless we are legally obligated to retain such data. Personal Data We Collect and How We Collect and Use It
When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, access date /times, pages viewed, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information”.
We may collect and maintain Personal Data regarding Site Visitors and Customers, including information:

Third Party Web Sites and Share Functionality
- Personal information collected is given to us voluntarily and, as such, you are giving us consent to use, collect and process such personal information. If you choose not to provide us with certain Personal Data, you may not be able to participate in or access certain aspects and areas of our website or content.
- You acknowledge that whenever you voluntarily make your personal information available for viewing by others online through, but not limited to, this website, it’s content, posting or commenting on social media, it may be seen, collected and used by others. Company shall not be responsible for any unauthorized or improper use of the information you voluntarily share.
- Third party advertisers may also use cookies or other technologies on the website, which are subject to the privacy terms and other terms and conditions of the relevant third party; and we are not in any way responsible for those policies.
- We may share personal data with our contracted service providers, such as order fulfillment, print on demand companies, or billing or payment processors, so that these providers can provide Services on our behalf. We also receive information about you from other sources, including service providers such as PayPal, Google, and Shopify, and through your interactions with us on social media websites, as well as through search engines.
- In addition, our Platform may offer social sharing features which will allow you to “Share” or “Like” on a Social Network. If you decide to use such features, it may allow the sharing and collection of Information both to and from such Social Network, so you should check the privacy policy of each Social Network before using such features.
- Unless described in this Privacy Policy, we do not share, sell, rent, or trade any information with third parties for their promotional purposes.
- Third Party Payment Service. We may make certain third-party payment service processors available to you such as PayPal, Shopify Payments, Apple Pay, etc. If you wish to use one of these Services, your personal information will be collected by such third party service and will be subject to the third party’s privacy policy. We have no control over this, and are not responsible for any third party’s collection, use, and disclosure of your personal information. In most cases, you must consent to separate terms for any payment processors utilized.
We collect this information:
- Directly from you when you provide it to us, including when you place an order on our website, create an account online, when you use our products or Services, subscribe to our email newsletter, enter a contest or promotion sponsored by us, communicate with us via third party social media Sites such as Facebook, or Instagram, request customer support, and contact us via phone, email, or text or otherwise communicate with us; and
- Automatically as you navigate the website (details below); and
- From third parties who process data on our behalf.
We collect Device Information using the following technologies:

Additionally when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers, email address, and phone number. When we mention “Personal Information” in this Privacy Policy, we mean both Device Information and Order Information.
Use of cookies for advertising and analytics:
Our website places a cookie on the hard drive of your computer. A "cookie" is a file which allows us to track and target the interests of users. In addition, our website uses third party cookies from Google Analytics for Display Advertisers, including the following features:
- Google Display Network Impression Reporting - which gives us additional insight into who has viewed our paid digital advertising on other websites. This will help us optimize and tailor our advertising.
- DoubleClick Platform integrations & Remarketing with Google Analytics – the integrations between both our web analytics and paid advertising platforms together to give us additional insight. This allows us to tailor our advertising to ensure the right types and offers are shown to you while you are using the internet outside our website.
- Google Analytics Demographics and Interest Reporting - which gives us insight into behavior information relating to visitor age, gender and interests on an anonymous and aggregate level. This will help us to understand browsing behavior to give you a better experience whilst visiting our sites.
Cookies are used to analyze your use of our website and to serve ads when you visit our website. The information we collect and share with third parties through cookies is aggregated and therefore anonymous (it does not include personal information which is likely to identify you). The information may be used to serve you ads in relation to our products when you visit our website and third party websites. How do we use your Personal Information?
We generally use the Order Information that we collect to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:

- Screen our orders for potential risk or fraud; and
- When according to the preferences you have shared with us, provide you with information or advertising relating to our products or Services.
We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).
Sharing your personal Information
We may share your Personal Information with third parties to help us use your Personal Information, as described above. The server automatically logs the IP address you use to access our website as well as other information about your visit such as the pages accessed, information requested, the date and time of the request, the source of your access to our website (e.g. the website or URL (link) which referred you to our website), and your browser version and operating system.

We do our best to only utilize third parties who have been deemed GDPR-compliant, and whom we have either completed a data processing Agreement with, or have reviewed and confirmed their policies regarding data processing to ensure compliance, but we cannot guarantee that any Site other than our own fully complies with those policies.
Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, court order, search warrant or other lawful request for information we receive, or to otherwise protect our rights, to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law.
Notwithstanding any of the above, we will not share your Personal Data if such sharing is prohibited by applicable privacy and data protection law, including, without limitation, the EEA’s General Data Protection Regulation effective May 25, 2018 and the California Consumer Protection Act (“CCPA”) which came into into effect on January 1, 2020.

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

Note, however, there is no industry consensus as to what site and app operators should do with regard to these signals. Accordingly, unless and until the law is interpreted to require us to do so, we do not monitor or take action with respect to “Do Not Track” signals. Your rights
Opting Out of Communications
As described above, we may use the Personal Data we collect from you to send you newsletters or other communications from us, including those promotional or marketing in nature.
If you do not wish to have your information used by the company to promote our own, or third parties’ products or services, you may opt out of receiving communications from us by sending an e-mail to love@goddessswag.com with the subject line “Opt Out.”
You may manage your receipt of marketing and non-transactional communications by clicking the “unsubscribe” link located on the bottom of our newsletter or marketing emails. Additionally, you may send a request specifying your communications preferences to love@goddessswag.com. Customers cannot opt out of receiving transactional emails related to orders placed through the Website.

International Data Transfers
If you are resident outside the United States, including in the EEA; European Economic Area (“EEA”), which includes the member states of the European Union (“EU”), we transfer Personal Data provided by you for processing in the United States, including Personal Information sent via e-mails or when you make an order. Under the GDPR, we are considered a “controller” and a “co-processor” of the Personal Data of EEA Residents. By providing Personal Data to us for the purpose of using the Platform, you consent to the processing of such data in the United States. The transfer of your Personal Data to the United States is necessary for the performance of a contract between you and us for your use of the Platform.
Please note that the United States does not have data protection laws equivalent to those in the EEA and other jurisdictions.
Rights of EEA Residents
This section of the Privacy Policy is applicable to residents of the EEA, which consists of the member states of the European Union. This section also applies to residents of Switzerland and, in the event of its departure from the EU, residents of the United Kingdom. Residents of the EEA, UK and Switzerland are referred to here as “EEA Residents.”
From May 25, 2018, all processing of Personal Data of EEA Residents is performed by us in accordance with the General Data Protection Regulation (2016/679) of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons regarding the processing of Personal Data and on the free movement of such data (“GDPR”).
Under the GDPR, we are both the controller and a co-processor of the Personal Data of EEA Residents. Our purpose for collecting and processing Personal Data from EEA Residents is to provide them with the features and functionalities of our Platform and information regarding our Platform. The legal basis for collecting Personal Data is because it is necessary for performance of a contract between us to provide you with the Platform and its related features and functionality. We also rely on your consent to receive information about our Platform. You may withdraw consent from receiving marketing and promotional communications by clicking the “Unsubscribe” link on the communication or sending an e-mail to love@goddessswag.com with the subject line “Opt Out.” If EEA Residents do not provide Personal Data to us or withdraw consent for processing such Personal Data, we may not be able to provide such residents with certain features or functionalities of the Platform or information regarding the Platform, including processing orders. Note that we do not collect any sensitive personal information about you.
If you are an EEA resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.
Additionally, if you are an EEA resident we are hereby notifying you that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.
Security of Transmission of Personal Information and Risks Related to the Internet
This Website has security measures in place to help protect against the loss, theft, misuse and unauthorized access, disclosure, alteration and destruction of the information under the Site Owner’s control. This Website uses no encryption (data scrambling) on certain portions of this Website, but uses encryption on portions where you are transmitting financial information, such as credit card information. When you are on any website that asks you for confidential information, you should check to see if the information being transmitted is encrypted in order to increase the security of your information. Although every effort is made to ensure no one else will view, seize or obtain your information, complete confidentiality and security is not yet possible over the Internet. Any unencrypted email communication over the Internet is not secure or confidential, and is subject to possible interception, loss and alteration. The Site Owner, its agents, administrators, employees and affiliates may not be held liable for any damages you or anyone else may suffer or incur as a result of the transmission of confidential or sensitive information over the Internet, and all such communications will be made at your own risk.
We seek to use reasonable organizational, technical and administrative measures to protect Personal Information under our control. For example, we seek to use Secure Sockets Layer ("SSL") technology for the placement of orders.

Unfortunately, no data storage system or data transmission over the Internet can be guaranteed to be 100% secure. Please also be aware that we may use third-party cloud service providers that provide hosting, data storage and other services pursuant to standard terms and conditions that may be non-negotiable; these service providers have informed us or the general public that they apply security measures they consider adequate for the protection of information within their system, or they have a general reputation for applying such measures.
Your California Privacy Rights
The following section pertains to the rights of individuals or households in California (“California consumers”).
ADDITIONAL DISCLOSURES RELATED TO COLLECTION, USE AND DISCLOSURE OF PERSONAL DATA
If you are a California resident, the California Consumer Privacy Act (“CCPA”) requires us to disclose the following information with respect to our collection, use and disclosure of personal data.
Under certain circumstances, California Civil Code Section 1798.83 states that, upon receipt of a request by a California consumer, a business may be required to provide detailed information regarding how that business has shared that customer’s Personal Information with third parties for direct marketing purposes. However, the foregoing does not apply to businesses like ours that do not disclose Personal Information to third parties for direct marketing purposes without prior approval or give customers a free mechanism to opt out of having their Personal Information disclosed to third parties for their direct marketing purposes.
Rights under the CCPA
After January 1, 2020, the CCPA (California Civil Code Section 1798.100 et seq.) will provide California consumers with additional rights regarding Personal Information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly with a particular consumer or household. The categories of Personal Information we collect are generally described above but differ for individual consumers depending on the Services used by such consumers.

Right to Know and Right to Delete
A California consumer has the right to request that we disclose what Personal Information we collect, use, disclose and sell. A California consumer also has the right to submit requests to delete Personal Information.
When we receive a request to know or delete from a California consumer, we will confirm receipt of the request within 10 business days and provide information about how we will process the request, including our verification process. We will respond to such requests within 45 days.
Right for Disclosure of Information
A California consumer may also submit requests that we disclose specific types or categories of Personal Information that we collect.
Under certain circumstances, we will not provide such information, including where the disclosure creates a substantial, articulable and unreasonable risk to the security of that Personal Information, clients’ accounts of information, or the security of our systems or networks. We also will not disclose California consumers’ social security numbers, driver’s license numbers or other government-issued identification numbers, financial account numbers, any health insurance or medical identification numbers, or account passwords and security questions and answers.

Verifying Requests
If we receive any request we will use a two-step process for online requests where the California consumer must first, clearly submit the request and then second, separately confirm the request. We will use other appropriate measures to verify requests received by mail or telephone.
In submitting a request, a California consumer must provide sufficient information to identify the consumer, such as name, e-mail address, home or work address, or other such information that is on record with us so that we can match such information to the Personal Information that we maintain. Do not provide social security numbers, driver’s license numbers, account numbers, credit or debit card numbers, medical information or health information with requests. If requests are unclear or submitted through means other than outlined above, we will provide the California consumer with specific directions on how to submit the request or remedy any deficiencies. If we cannot verify the identity of the requestor, we may deny the request.
California Do Not Track Disclosures
Although some browsers currently offer a “do not track (‘DNT’) option,” no common industry standard for DNT exists. We therefore do not currently commit to responding to browsers’ DNT signals or settings. For information about Do Not Track, please visit www.allaboutdnt.org.
JURISDICTIONAL ISSUES
Goddess Swag operations are controlled and operated by us from the United States, and are not intended to subject us to the laws or jurisdiction of any state, country or territory other than that of the United States.
Data retention
When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.
Changes
We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
